Premises Liability Litigation

The owner of any property, whether it’s a business or used for residential purposes, is obliged to ensure it is maintained and operated safely. At The Simpson Tuegel Law Firm, we know that all too often this is not the case, and many Americans each year are injured or killed because of negligence by property owners.

If you were injured or a loved one was killed on someone else’s property, you may be entitled to damages. We seek justice on your behalf and hold negligent parties accountable to compensate victims and ensure no one else is put in harm’s way.

What is premises liability?

Premises liability refers to the necessary precautions, often called the “duty of care,” that a property owner or renter must take to ensure the property is reasonably safe for visitors. The scope of a property owner’s duty of care centers around the nature of the injured party’s visit to the premises, specifically whether they were an invitee or licensee.

Premises liability applies to homes, stores, office buildings, public property, restaurants, bars, entertainment venues, hotels, and more. While on-premises “slip and falls” are common examples of premises liability, a multitude of accidents can fall under the premises liability umbrella. Meritorious claims may include dog bites, security negligence, inadequate maintenance, substandard fire safety, swimming pool accidents, amusement park accidents and many more. Victims may be eligible for a range of premises liability damages, including:

• Lost wages and lost earning capacity
• Cost of medical care (including past and future care)
• Pain and Suffering
• Emotional trauma
• Wrongful death
